Effective Date: June 20, 2026
These Terms of Service ("Terms") govern your access to collinspainting.net (the "Website") and the engagement of painting subcontractors through the Collins Painting Network ("Company," "we," "our," or "us"), headquartered in Windsor, Ontario, Canada. BY VISITING THE WEBSITE, SUBMITTING AN APPLICATION, OR CONSENTING TO RECEIVE ELECTRONIC COMMUNICATIONS, YOU AGREE TO BE BOUND BY THESE TERMS.
Collins Painting Network connects qualified, independent painting subcontractors ("Subcontractors," "Network Members," "you") with residential and commercial painting jobs ("Jobs") generated and managed by Collins Painting. Collins Painting acts as the sales, project management, and lead-generation layer; Network Members perform the physical labor as independent contractors — not employees.
Application. Prospective Subcontractors apply via the Website. We may request references, work history, insurance certificates, and proof of competency.
Vetting. Collins Painting reviews each application and reserves the right to approve, defer, or decline any applicant at its sole discretion. Approval into the Network is not a guarantee of job assignment.
Independent Status. Approved Network Members are independent contractors. Nothing in these Terms creates an employment, agency, or partnership relationship. Network Members are responsible for their own taxes, insurance, equipment, crew, and compliance with all applicable laws.
Job Board. Available jobs are posted on our digital job board. Network Members may accept or decline jobs at their discretion, subject to the terms posted with each job.
Scope of Work. Each job includes a written scope of work describing areas, surface conditions, products, colours, start date, and projected completion. Network Members must follow the agreed scope.
Change Orders. Price or timeline adjustments due to hidden conditions (moisture damage, mold, pest infestation, unsafe substrates, structural movement) must be documented and approved in writing before additional work proceeds.
Quality Standard. All work must meet Collins Painting's "Prep — Paint — Perfection" standard. Network Members are responsible for warranty-related callbacks on their own work.
Payout Rates. Payout terms for each job are stated on the job board listing before acceptance. Payouts are calculated as agreed and are payable upon successful completion and customer sign-off.
Invoicing. Network Members submit completion documentation per the job requirements. Payment is processed within the timeframe specified per job (typically 7–14 business days of approved completion).
Late or Disputed Work. If work fails to meet the agreed scope or quality standard, Collins Painting may withhold or adjust payout pending remediation.
Accepted Methods. Payments are issued via e-transfer, direct deposit, or cheque as arranged.
Network Members agree to:
Network Members warrant their labor for two (2) years from the invoice date against peeling, blistering, or chipping caused by defective workmanship. Warranty claims must be remedied by the originating Network Member at no cost to Collins Painting or the customer. Full warranty details are on our Warranty page.
Exclusions: Normal wear, fading, or damage from weather, moisture intrusion, structural movement, or inadequate ventilation. Failures where the underlying surface was previously compromised but not visible at the estimate. Coatings or materials supplied contrary to our specifications.
Network Members may decline or reschedule jobs up to 72 hours before the agreed start date without penalty. Unexcused abandonment of an accepted job may result in removal from the Network and liability for mobilization costs.
Commercial electronic messages (SMS, MMS, RCS, email, or voice) are sent only after your clear, affirmative opt-in — for example, submitting the application form, replying YES, or signing a subcontractor agreement referencing these Terms.
Every call-to-action includes: the program name ("Collins Painting Network"), our legal name and address, "Msg & data rates may apply," message frequency ("up to 4 msgs/mo" for promotions; job-status alerts up to one per workday), links to these Terms and our Privacy Policy, and a statement that consent is not a condition of participation.
Text STOP (or END, CANCEL, UNSUBSCRIBE, QUIT) to cancel, or HELP for assistance. A confirmation of your opt-out is the final message you'll receive.
Wireless carriers do not guarantee message delivery and are not liable for delayed or undelivered messages.
We log the phone number/email, opt-in method, timestamp, IP address (for web forms), and any relevant screenshots for at least three (3) years to demonstrate compliance.
For Canadian recipients, every electronic message is a "Commercial Electronic Message" under CASL. We obtain express consent unless an exemption applies; clearly identify ourselves and provide contact data; and include a working unsubscribe link or keyword, functional for at least 60 days.
Our separate Privacy Policy explains what personal information we collect, how we safeguard it, and your rights of access or correction.
The Website's content is provided "as-is" for general information. We strive for accuracy but do not guarantee completeness or suitability. You may not scrape, copy, or republish any text, images, or code without written permission; nor may you use the Website to transmit unlawful, harmful, or unsolicited content.
To the fullest extent allowed by law, Collins Painting is not liable for any indirect, incidental, special, consequential, or punitive damages, or lost profits/revenue, arising from your use of the Website or participation in the Network. Our aggregate liability for any claim is limited to the amount of payouts received by the Network Member for the specific job giving rise to the claim.
Network Members agree to indemnify and hold harmless Collins Painting, its owners, employees, and agents from any claims, damages, or expenses arising out of: (a) breach of these Terms; (b) negligent or wrongful acts; or (c) failure to secure the work site or comply with safety regulations.
These Terms are governed by the laws of the Province of Ontario and applicable federal laws of Canada. The courts of Windsor, Ontario have exclusive jurisdiction over any dispute.
We may amend these Terms at any time. Changes take effect when posted on this page with an updated "Effective Date." Continued use of the Website or the Network after notice constitutes acceptance.
